FIGHT YOUR DENIAL WITHIN THE 60-DAY APPEAL WINDOW TO SECURE YOUR MONTHLY BENEFITS & BACK PAY

If your Social Security Disability claim was denied, you have a strict deadline of 60 days from receiving your denial letter to file an appeal. Missing this window can force you to restart your entire claim from scratch.

When we win your appeal, you receive ongoing monthly benefits plus a lump-sum payment for your back benefits. This back pay covers the full monthly amount you were owed starting from the date your disability began (after the standard 5-month waiting period) up to your approval date. You pay us nothing out-of-pocket for our help.

HOW THE SSA DECIDES YOUR DISABILITY CLAIM

Understanding the five-Step Evaluation & The SSA "Blue Book"

The Social Security Administration (SSA) evaluates every disability claim using a strict 5-Step Sequential Evaluation Process. Knowing where your claim stands is key to winning an approval:

Step 1 - Work Activity (SGA): The SSA checks if you are currently working and earning above the Substantial Gainful Activity (SGA) monthly limit.

Step 2 - Severity of Condition: Your physical or mental impairment must be severe enough to significantly limit basic work activities (such as sitting, standing, lifting, or remembering) for at least 12 months.

Step 3 - The Blue Book Listing: The SSA compares your medical records against its official Blue Book—a master catalog of disabling medical conditions and clinical criteria. If your condition meets or equals a listing, your claim is approved immediately.

Step 4 - Past Relevant Work: If your condition doesn't match a listing, the SSA evaluates your Residual Functional Capacity (RFC) to see if you can still perform any job you held in the past 5 to 15 years.

Step 5 - Ability to Do Other Work: The SSA determines if you can adjust to any other type of full-time work available in the national economy, considering your age, education, and work skills.

What if your condition isn't in the Blue Book?

You do not need a listed Blue Book condition to win. Most claims are approved at Steps 4 and 5 by proving through medical records and doctor statements that your functional limitations prevent you from holding a job.

TRANSPARENT FEES & BACK PAY EXPLAINED

How Your Lump-Sum Payment Is Calculated & What Our Help Costs

When your Social Security Disability claim is approved, you are often entitled to a lump-sum payment for past-due benefits, known as back pay.

No Win, No Fee:

You pay us $0 upfront and nothing out-of-pocket. If we do not win your claim, you owe us nothing.

SSA-Regulated Fee Cap:

By federal law, attorney fees for SSD claims are standard & strictly capped at 25% of your back-pay lump sum or $9,200 (whichever is lower).

Direct SSA Payment:

The SSA pays our fee directly out of your back-pay lump sum when you win. We never touch your ongoing monthly disability checks.

  • What is the Social Security Disability application process?

The SSD application process involves completing a simple form. Get started right now!

  • What kind of Social Security Disability benefits are available?

There are two main types of Social Security Disability (SSD) benefits available to eligible individuals:

    1. Social Security Disability Insurance (SSDI): SSDI benefits are available to individuals who have worked and paid Social Security taxes for a certain period, earning enough work credits to qualify for benefits. These benefits are based on the individual's work history and are intended to replace lost income due to a disability that prevents them from engaging in substantial gainful activity (SGA).
    2. Supplemental Security Income (SSI): SSI benefits are available to disabled individuals who have limited income and resources, regardless of their work history. SSI provides financial assistance to help meet basic needs such as food, shelter, and clothing for individuals who are elderly, blind, or disabled. Unlike SSDI, SSI benefits are not based on work history but are subject to strict income and asset limits.

Both SSDI and SSI provide essential financial support to individuals with disabilities, but the eligibility criteria and application process differ between the two programs. We can help you understand the distinctions between SSDI and SSI to determine which benefits you may be eligible for and to navigate the application process effectively.
